  • M v M (Abduction: Settlement) [2008] 2 FLR 1884 where Black J ordered the return of two children to Poland notwithstanding that they had been in the UK for more than 12 months and the children’s strong wish to remain in the UK.
  • Re F (A Child) [2009] EWCA Civ 416 where the Court of Appeal approved the decision of the judge to decline to return a 7 year old child in abduction proceedings solely on the basis of the child’s own views. Thorpe LJ also gave guidance on how to resolve conflicts of expert evidence as to whether a parent has ‘rights of custody’ under foreign law in Brussels II cases bu involving his office and international liaison judges.
